Miva AI / Miva Skills Navigator — User Agreement

1. What Miva AI / Miva Skills Navigator Does

Miva Skills Navigator helps unemployed youth use AI and human support to learn a trade or skills. It provides learning pathways, competency guidance, and educational support. Miva AI is a small language model designed to run local-first in remote areas of Africa, including air-gapped and low-connectivity environments. Using either product means you agree to these terms.

2. Acceptable Use

You agree to use Miva AI / Miva Skills Navigator only for lawful purposes. By using these applications, you agree NOT to:

• No Hacking: Attempt to gain unauthorized access to any part of the application, its servers, databases, source code, APIs, or any systems connected to it. This includes but is not limited to SQL injection, brute-force attacks, reverse engineering, packet sniffing, circumventing authentication, exploiting vulnerabilities, or attempting to overwhelm the system with automated requests (DDoS).
• No Unlawful Activity: Use the platform to plan, promote, or carry out any activity that violates the laws of your country, your host country, or international law. This includes but is not limited to fraud, money laundering, terrorism, human trafficking, drug trafficking, cybercrime, or any activity that harms another person.
• No Derivative Competing Products: You may NOT copy, clone, scrape, replicate, fork, or otherwise reproduce the design, content, structure, data, user interface, branding, models, or functionality of Miva AI / Miva Skills Navigator to create a derivative application that competes in the same marketplace or targets the same user demographic. This includes launching a similar skills-training, trade-learning, or local-first language-model product that draws substantively from Miva AI's content or architecture.

3. Your Account

• You are responsible for keeping your login credentials secure.
• You must provide accurate information when registering.
• You are responsible for all activity under your account.
• One person, one account. No account sharing or selling.
• You must be at least 13 years old to use these applications. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these terms on your behalf.

4. User Content

• Any information you submit (career preferences, quiz answers, profile data, prompts, or chat messages) is treated as your personal content.
• You retain ownership of your content.
• You grant Miva AI a non-exclusive license to process your content solely to provide and improve the service for you.
• You agree not to submit content that is illegal, harmful, defamatory, infringes on someone else's intellectual property, or contains malware.
• Miva AI reserves the right to remove content that violates these terms.

5. Privacy & Data Protection

• Miva AI respects your privacy. Personal data is handled in accordance with the applicable data protection laws of your jurisdiction.
• These applications may operate in air-gapped or low-connectivity modes. Your data may be stored locally on your device or on servers you control.
• Miva AI does not sell your personal data to third parties.
• A separate Privacy Policy provides full details on data collection, storage, and your rights.

6. Intellectual Property

• Miva AI / Miva Skills Navigator, including their names, logos, code, models, content, design, and the Alpha Centauri branding, are the intellectual property of Miva AI and John Esseboe.
• You may not use the Miva AI or Miva Skills Navigator names, logos, or branding without written permission.
• Educational content, skill frameworks, and AI-generated suggestions are provided for your personal use and may not be redistributed commercially without a license.
• Open-source components used in these applications retain their original licenses.

7. Subscription & Payment

• Your subscription price is based on the daily minimum wage of your country, capped at a minimum of $1.00 USD per 6-month subscription period.
• Where your country's daily minimum wage is below $1.00, a donor subsidizes the difference. You pay only your country's symbolic daily wage amount.
• Subscriptions renew every 6 months. Prices are reviewed at each renewal based on IMF inflation projections for your country.
• You may cancel your subscription at any time. Refunds are issued on a pro-rata basis for unused months if cancellation occurs before renewal.
• Payment is processed through the payment method available in your region (mobile money, card, or bank transfer).

8. Disclaimers

• Miva AI / Miva Skills Navigator provide skill guidance, educational support, and model-generated answers based on available data. These are suggestions, not guarantees.
• The Provider is not responsible for employment outcomes, salary expectations, or career or learning decisions you make based on either application's recommendations or outputs.
• The service is provided "as is" without warranties of any kind, express or implied.
• The Provider does not guarantee uninterrupted or error-free operation.

9. Limitation of Liability

• To the maximum extent permitted by law, Miva AI shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of either application.
• The Provider's total liability for any claim shall not exceed the amount you paid for your subscription in the 6 months preceding the claim.

10. Termination

• Miva AI may suspend or terminate your account if you violate these terms, especially Sections 2 (Acceptable Use) and 6 (Intellectual Property).
• You may delete your account at any time. Upon deletion, your personal data is removed within 30 days.
• Upon termination, all licenses granted to you under this agreement end immediately.

11. Governing Law & Disputes

• This agreement is governed by the laws of the jurisdiction in which Miva AI is registered.
• Any disputes will first be attempted through good-faith negotiation. If unresolved, disputes will be submitted to arbitration in accordance with the rules of the arbitration body in the Provider's jurisdiction.
• Users in ECOWAS member states may also seek recourse under applicable ECOWAS consumer protection protocols.

12. Changes to This Agreement

• Miva AI may update this agreement periodically. Users will be notified 30 days before changes take effect.
• Continued use after the effective date of changes constitutes acceptance of the updated terms.
